Letter of Authorization for the Huawei Product Online Upgrade Service
Huawei devices support automatic download and self-service upgrade to help you learn about the mainstream versions of the devices and quickly perform device upgrade and repair. After enabling the automatic version upgrade check function on the web platform of devices. You hereby authorize Huawei Technologies Co., Ltd. (hereinafter referred to as Huawei) to exchange information with your devices through the Huawei Online Upgrade Platform (https://houp.huawei.com) to collect information such as device models, IP addresses, basic software versions and patches, and device ESNs. The information will be used to ensure that your devices are purchased through Huawei's authorized channels and authorized sales regions, match the versions or patches that can be upgraded and return the information such as the upgrade versions or patches and the download URLs of software packages to your devices. After you confirm the upgrade, the devices will automatically download the software packages and implement an upgrade. When the upgrade is completed, the upgrade result will be uploaded to Huawei online upgrade platform.
If you select the Letter of Authorization for the Huawei Product Online Upgrade Service and enable the automatic version check and update function, you have read, understood, and agreed to all contents of this authorization letter. Otherwise, stop related operations.
- 1. Scope of Authorization
Authorization Date
The authorization takes effect after you select the Letter of Authorization for the Huawei Product Online Upgrade Service and enable the automatic version check and update function.
Term of Authorization
From the date of authorization to the EOFS of devices(EOFS: End of Full Support)
- 2. Commitment and Guarantee
For the purpose of this authorization, you agree and promise:
- 1. You are entitled to access and use the Huawei Product Online Upgrade Service according to the restrictive, revocable, non-exclusive, non-sublicensable, and non-transferable usage license authorized by Huawei.
- 2. During the online upgrade of Huawei products, the Huawei Online Upgrade Platform needs to exchange data with your network and network devices, and collect information such as device models, IP addresses, basic software versions and patches, and device ESNs. The information will be used to ensure that your devices are purchased through Huawei's authorized channels and authorized sales regions, provide you with the Huawei Product Online Upgrade Service, and Huawei does not detect, check, monitor, modify, or intercept your content. You agree and authorize Huawei to perform the preceding operations.
- 3. The Huawei Product Online Upgrade Service must comply with relevant laws and regulations, as well as agreements on the Huawei Product Online Upgrade Service.
- 4. You are responsible for the legal compliance, accuracy, integrity, and availability of your content, and assume responsibilities independently. You are committed to protecting Huawei from any loss incurred.
- 5. You shall not use the Huawei Product Online Upgrade Service beyond the scope and purpose authorized by Huawei or by unauthorized means, including but not limited to modifying, smearing, tampering, or creating any derivative of any software in the Huawei Product Online Upgrade Service, as well as reverse engineering, disassembly, or decompilation. In addition, you shall not use the Huawei Product Online Upgrade Service for the purpose of creating the same or competitive services.
- 6. Without written authorization from Huawei, you shall not license, sell, lease, transfer, or distribute in any form the Huawei Product Online Upgrade Service, or use it for other commercial purposes.
- 7. When using the Huawei Product Online Upgrade Service, you shall not compromise or attempt to compromise network security through actions including but not limited to malicious scanning of websites and services, illegal intrusion of systems, and illegal acquisition of data by using viruses, Trojan horses, malicious coding, and phishing.
- 8. You shall not attempt to change the system configuration of the Huawei Online Upgrade Platform for malicious purposes or damage the security of the Huawei Product Online Upgrade Service system.
For the purpose of this authorization, Huawei promises to take reasonable and feasible measures to protect your network data security, prevent accidental, illegal, unauthorized loss, and access or data leakage events, and perform corresponding operations under your authorization.
- 3. Warranty Disclaimer
You understand and agree that Huawei is not liable for any of the following situations:
- 1. Any loss caused by force majeure, including but not limited to network faults, power interruption, natural disasters, hacker attacks, and network viruses.
- 2. Any loss caused by you or a third party, including but not limited to your improper operations, improper backup, and infringement by a third party.
- 3. Any loss caused by your violation of the preceding commitments or any agreement on the Huawei Product Online Upgrade Service.
- 4. Other Information
This Letter of Authorization is governed by and construed in accordance with the laws of the People's Republic of China.
Any dispute arising from this Letter of Authorization and the authorization shall be settled amicably through negotiations by both parties. If the negotiation fails, both parties agree to submit the dispute to Shenzhen Longgang District People's Court for resolution through litigation.
