QuoTracker End-user License Agreement |

This agreement is a legal contract between you (either an individual or single entity) and Sunnymoon Consulting for its software product QuoTracker. You should carefully read the following terms and conditions before using this software. Unless you have a different license agreement signed by Sunnymoon Consulting, your use of this software indicates your acceptance of this license agreement.
NEW: We are trying to make QuoTracker free through showing advertisement in it. Of course, registered users won't be affected by any ad-banners. Unregistered users will see ad-banners displayed on the QuoTracker main window and on the QuoExplorer window. The ad-banner integration is still under test. Because of this, an extended trial period of 60 days applies. This agreement will be reworked once the test of the integration is complete.
This is not free software. Subject to the terms below, you are hereby licensed to use this software for evaluation purposes without charge for a period of 60 days. After the 60 day evaluation period, you can still use it, however, some key functions are disabled. If you want to use this software after the evaluation period in its full functionality, you have to register the software and a small amount of charge is required, as described in Registering and Ordering QuoTracker.If you are interested in QuoTracker but feel that it is not yet in the shape for you to register, you are welcome to try all the new versions to be released. You can try all new versions for 60 days with its full functionality.
If you are using this software on an evaluation basis, you are hereby licensed to make copies of the evaluation version as you wish; give exact copies of the original evaluation version to anyone; and distribute it in its unmodified form via electronic means. You may not charge any distribution fee for the copy or use of the evaluation software itself, but you may charge a distribution fee that is reasonably related to any cost you incur distributing the evaluation software (e.g. packaging). You must not represent in any way that you are selling the software itself. Your distribution of the evaluation software will not entitle you to any compensation from Sunnymoon Consulting.
One registered copy of QuoTracker may either be used by a single person who uses the software personally on one or more computers, or installed on a single workstation used non-simultaneously by multiple people, but not both.You may access the registered version of QuoTracker through a network, provided that you have obtained individual licenses for the software covering all workstations that will access the software through the network. For instance, if several workstations can access QuoTracker on the network, each workstation must have its own QuoTracker license, regardless of whether they use QuoTracker at different times or concurrently.
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. In particular, there is no warranty for the correctness of the data provided or processed by QuoTracker, although every effort is made to avoid incorrectness or inaccuracy. You should test the program with non-critical data before relying on it. The user must assume the entire risk of using the program.

This License Agreement is a legal agreement between you (either an individual or a single entity) and Aureate Media Corporation ("Aureate Media") for use of the AdSoftware System, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT, this software"). "SOFTWARE PRODUCT" also includes, and this Agreement also governs, any later release or update of the AdSoftware System which Aureate Media makes generally available without additional charge of licenses or your release or the SOFTWARE PRODUCT, and any copy of the SOFTWARE PRODUCT made in accordance with this Agreement. By downloading, installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this License Agreement. IF YOU DO NOT AGREE TO THE TERMS OF THIS LINCENSE AGREEMENT, ABORT THE INSTALLATION AND REMOVE THIS AND RELATED SOFTWARE FROM YOUR COMPUTER SYSTEM IMMEDIATELY.
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.
This SOFTWARE PRODUCT is "advertiser supported software," meaning that some or all of the costs associated with the development and distribution of this SOFTWARE PRODUCT is recuperated through the use of advertisements displayed in the software product. These advertisements are delivered via the Internet and will be downloaded from the servers of Aureate Media or their subcontractors, partners, or other authorized parties. By using this software, you agree that you understand that this software will connect to the Internet UBIQUITOUSLY to download advertisement and/or to provide software updates. You also accept responsibility for any network usage costs or any other costs incurred by using this software.
All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, documentation, media, online documentation, text, and "web integration" incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by Aureate Media or its authorized agents. As a licensee, you own the media on which the SOFTWARE PRODUCT is recorded, but Aureate Media and all Third Party Suppliers retain title and ownership to the SOFTWARE PRODUCT recorded on the media and all copyright and other intellectual property rights therein. This license is not a sale of the software or any copy. Except as may be required under applicable law, you agree not to alter, decompile, disassemble, or reverse engineer the SOFTWARE PRODUCT, in whole or in part, whether for error correction or otherwise. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions.
You agree not to alter, remove or obscure any copyright notices or other proprietary notices on and in the software.
LIMITED WARRANTY
NO WARRANTIES. - Aureate Media EXPRESSLY DISCLAIMS ANY WARRANTY for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you.NO LIABILITY FOR DAMAGES. In no event shall Aureate Media or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this SOFTWARE PRODUCT, EVEN IF AUREATE MEDIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
